Anbei die Diskussion auf Candlekeep. Die Seite hat ihr Candlekeep Logo bereits geändert.

Man müßte mal schauen, inwieweit sich das auf's Gate und alle bislang erschienen BEiträge auswirkt. So wie's aussieht, gilt die Policy für 4E - Zeugs und bestimmte Marken.

* No Fee or E-Commerce Activity. Your Fan Site is for your own personal use. You may not engage in any e-commerce activities on your Fan Site including, but not limited to, sale of products or professional services. For purposes of this Policy, donations/tip jars and general advertising are not considered "e-commerce" activities.


* No Endorsement or Sponsorship. You may not use or display Wizards' trademarks or copyrighted materials in a manner likely to create the impression that Wizards is an official sponsor or author of your Fan Site, or that Wizards endorses or has otherwise expressly licensed the Fan Site. Any endorsement or sponsorship must be approved by Wizards in a separate agreement.


* Use Trademark and Copyright Notices. All Fan Sites must include the correct copyright and trademark information on each page that contains content related to Wizards' property. Ich habe die Policy durchgelesen und etwas sehr Spezielles oder Unerwartetes habe ich nicht gesehen. Der wichtigste Satz aus dem ganzen Teil ist folgender:

"However, if Wizards becomes aware of infringing and/or objectionable uses of Wizards Materials on your Fan Site, Wizards will contact you and/or your Fan Site operator to try to resolve the matter. If we are unable to reach a reasonable resolution, or if we become aware of a pattern of violations of our Policy, we may pursue appropriate legal action."

Zanan liegt aber falsch was den Umfang der Fan Policy betrifft:

Daher keine grds. Beschränkung auf 4E Material und 3E Material kann genauso davon profitieren, allerdings ist es natürlich denkbar, dass in dem Toolkit kein 3E Material (oder gar noch älteres 2E/1E Material) im Toolkit veröffentlicht wird.

Letztlich wird das die spannende Frage. Was kommt alles in das Toolkit und kann somit für Fan-Seiten verwendet werden. Alles andere unterliegt dann wie gehabt dem normalen Urheber- bzw. Markenrecht.

Für das Gate hat das meines Erachtens wenig Auswirkung, da wir ja sowieso uns an die bestehenden gesetzlichen Vorschriften gehalten haben.

Wird? Das Fankit ist draussen und es ist "nur" 4E Material drin. Kein Anlass hier zu spekulieren. Die Policy ist ja primär für den Gebrauch des Kits geschrieben, geht aber in gewissen Stellen darüber hinaus. Wie und ob die Prä4E Welt davon betroffen ist scheint schwammig und offen für Interpretationen zu sein.

Ok, habe mir mal das Fan Toolkit runtergeladen und der Inhalt ist ein Witz (nur wenige Bilder, hauptsächlich Cover von 4E Büchern). Da hätte man durchaus mehr erwartet, hoffen wir, dass da schnell noch mehr reinkommt.
Planen ist alles, Pläne sind nichts.

Sehr unwahrscheinlich. Allerhöchstens die Covers neuer Bücher. Problematisch ist primär die Klausel, dass die Inhalte nicht verändert (Skalierung ausgenommen) werden dürfen. Einerseits verständlich und kaum anders definierbar aber in der Realität des Webdesigns absolut unbrauchbar. Fokussieren und Stutzen ist praktisch immer notwendig.

Der letzte Absatz reißt doch alles raus, es wird im Grunde garantiert, dass man zunächst eine gütliche Einigung suchen wird.
Oder anders: Wir machen weiter wie bisher (also nach bestem Wissen und Gewissen dem Recht und Willen folgend) und erst wenn jemand meckert muss man sich drum kümmern.

Was "Alteration" angeht... naja ist das Einbinden in eine Website nicht auch schon "alternating"? Ich meine... man gibt dem Bild einen Rahmen.
Und warum sollte man solch einen Rahmen nicht auch mit anderen Techniken als HTML realisieren können/dürfen/whatever.
Oder anders: Mit HTML darf ich einen Text über das Bild schreiben aber mit GIMP nicht? Das ist doch im juristischen Sinne kein Unterschied!?

Aber wie gesagt, der letzte Absatz reißt es raus, wenn also jemand da Elemente verändert ist es okay bis sich jemand beschwert... sowhat?

Fraglich ist für mich nur, ob wir weiterhin das Wizards-Logo auf der News-Seite verwenden sollten und ob ich jetzt immer wenn ich "Wizards" schreibe unter mein Posting

Im Rahmen der Wiki, die ja gerade für die Wildniss auf- und ausgebaut wird stellt sich die Frage der Lizenzierung.
Klar ist dass 3.x-Regelmaterial unter OGL kommt
Die Flufftexte werden wohl CreativeCommons oder Copyright oder... mal sehen, kann man ja diskutieren (im Zweifel Entscheidung des Users)
Aber 4E-Regeln müssen ja auch irgendwie mit einer Lizenz versehen werden und da war meine erster Gedanke "GSL" und der zweite "ach nee, die gilt ja nur wenn unterschrieben aber da war doch 'ne Fan-Site-Police" und dann habe ich diesen Thread geöffnet und nochmal überflogen und mir ist es noch immer nicht klar...

Also den ersten Absatz verstehe ich so, dass Fan-Material doch unter GSL lizenziert werden soll... wo ja irgendwann mal gesagt wurde, dass dem nicht so sei. Afaik MUSS man natürlich nicht 4E-Material darunter stellen, aber ich befürchte, dass man dann aufpassen muss, welche Termini man verwendet... oder so...

Den zweiten Absatzh versteh ich so, dass ich immer wenn ich "Power" schreibe auch © schreiben muss und außerdem irgendwo auf der gleichen Seite den Absatz da oben (also dass das ein Spiel-Terminus aus dem D&D-Spiel ist und dass das Spiel von WotC ist und überhaupt dass die das Copyright halten und hastenichtgesehen).

Kann mir das jemand bestätigen, der mehr Ahnung vom amerikanischen Recht hat :wink:
War'n Witz, ich meine natürlich der mehr Ahnung von der englischen Sprache hat :)

Wobei - soweit ich weiß war da irgendwas von wegen ausländische Texte hier nicht gültig oder sowas... keine Ahnung, aber wie gesagt, wenn man das 4E-Material NICHT unter die GSL stellt, dann muss man ja wahrscheinlich aufpassen was man schreibt, weil ggf. bestimmte Begriffe eben doch geschützt sind (wobei auch hier: Siehe mein vorheriges Posting, kann man auch erstmal abwarten, dass/ob jemand meckert)

Erst mal das wichtigste vorweg, die Fansite Poliy gilt  nur, wenn du sie vorher akzeptierst. Insofern musst du dir über deren Inhalt keinerlei Gedanken machen, wenn du die bislang sehr "bescheidenen" Vorteile der "Policy" überhaupt nicht nutzen willst.

Natürlich gelten dann die normalen gesetzlichen Vorschriften. Ansonsten ist aber die Verwendung von marken- oder urheberrechtlich geschützten Material nach der Policy entsprechend zu Kennzeichnen. Hier ist wichtig zu wissen, dass natürlich nicht jedes einzelne Wort urheberrechtlich bzw. markenrechtlich geschützt ist. Der Markenname Wizards of the Coast wäre natürlich markenrechtlich geschützt. Das Bild des Artificiers, welches im Fansite Kit enthalten ist, ist Urheberrechtlich geschützt. Das Wort "Power" aber natürlich nicht.

Übrigens fallen die 3.X Regeln nicht automatisch unter die OGL, sondern nur einige und natürlich muss man dann auch die Bedingungen der OGL erfüllen. Der Großteil des Gate-Material entspricht nicht der OGL, was aber auch nicht schlimm ist :)

Oh okay, hab ich wohl überlesen, also wenn man das FanKit nicht braucht sind die Regeltermini erstmal "frei" (im Sinne von ungeschützt) und man kann 4E-Regeln getrost unter irgendeine geläufige Lizenz stellen (©arr notfalls). Wobei mir eben noch nicht klar ist was mit Begriffen ist, die WotC wohl erfunden haben dürften wie "Eladrin" oder "Kuo-Toa" (denk' ich jedenfalls dass das neue Begriffe sind). Selbst wenn er nicht markenrechtlich geschützt sein sollte hält WotC selbstredend das Urheberrecht daran (und natürlich alle Nutzungsrechte) andererseits... wahrscheinlich dann doch nicht, weil es nicht die nötige "Schöpfungshöhe" erreicht oder wie das noch gleich heißt (ich denke jedenfalls, dass ein einzelner Begriff, welcher nicht markenrechtlich geschützt ist nicht die nötige Schöpfungshöhe erreichen kann).

Öhm also ich habe mir vor einer ganzen Weile mal die OGL durchgelesen und eigentlich wüsste ich aus dem Kopf jetzt nicht...
Klar, das Gate-Material entspricht in sofern nicht der OGL, dass diese Verlangt selbst mit publiziert zu werden, aber sonst... war ich eigentlich immer der Ansicht der Kram sei kompatibel. Auch die 5%-Klausel dürfte in aller Regel erfüllt sein.
Richtig ist auf jeden Fall, dass das Material im Gate idR bisweilen nicht unter der OGL steht, denn das müsste ja dran stehen, aber wie gesagt, ich war eigentlich stehts der Ansicht es könnte. Also warum meinst du das nicht?

Erst mal das wichtigste vorweg, die Fansite Poliy gilt  nur, wenn du sie vorher akzeptierst. Insofern musst du dir über deren Inhalt keinerlei Gedanken machen, wenn du die bislang sehr "bescheidenen" Vorteile der "Policy" überhaupt nicht nutzen willst.
Oh okay, hab ich wohl überlesen, also wenn man das FanKit nicht braucht sind die Regeltermini erstmal "frei" (im Sinne von ungeschützt) und man kann 4E-Regeln getrost unter irgendeine geläufige Lizenz stellen (©arr notfalls). Wobei mir eben noch nicht klar ist was mit Begriffen ist, die WotC wohl erfunden haben dürften wie "Eladrin" oder "Kuo-Toa" (denk' ich jedenfalls dass das neue Begriffe sind). Selbst wenn er nicht markenrechtlich geschützt sein sollte hält WotC selbstredend das Urheberrecht daran (und natürlich alle Nutzungsrechte) andererseits... wahrscheinlich dann doch nicht, weil es nicht die nötige "Schöpfungshöhe" erreicht oder wie das noch gleich heißt (ich denke jedenfalls, dass ein einzelner Begriff, welcher nicht markenrechtlich geschützt ist nicht die nötige Schöpfungshöhe erreichen kann).

Das Urheberrecht kann man nur an "Werken" haben und das Wort Eladrin oder Kuo-Toa ist kein Werk. Ein Bild von beiden wäre dagegen ein Werk ebenso wie eine Geschichte und evtl. auch dessen Spielwerte (umstritten). Ich bezweifle auch, dass es sich um Markennamen handelt.

Klar, das Gate-Material entspricht in sofern nicht der OGL, dass diese Verlangt selbst mit publiziert zu werden, aber sonst... war ich eigentlich immer der Ansicht der Kram sei kompatibel. Auch die 5%-Klausel dürfte in aller Regel erfüllt sein.
Richtig ist auf jeden Fall, dass das Material im Gate idR bisweilen nicht unter der OGL steht, denn das müsste ja dran stehen, aber wie gesagt, ich war eigentlich stehts der Ansicht es könnte. Also warum meinst du das nicht?

Das ist z.B. eine Bedingung der OGL die nicht erfüllt ist. Hinzu kommt, dass viele Materialien auf Nicht-SRD Regeln zumindest verweisen und es da hakelig wird. Ausnahme sind in der Regel die Contest-Beiträge, wo nämlich darauf geachtet wurde.

Wie gesagt, wir müssten uns bislang keine Sorgen machen und ich denke auch zukünftig nicht, aber evtl. sollten wir das "intern" weiterdiskutieren.
